These terms cover this website and any software published by XYZ Makes LLC. Work done under a signed statement of work is governed by that agreement, and where the two disagree, the agreement wins.
The website
The site is provided as it is. The studio tries to keep it accurate and available and makes no promise that it always will be. Descriptions of services are a starting point for a conversation, not an offer capable of acceptance — nothing here forms a contract.
Content and marks
The text, design, code and images on this site belong to XYZ Makes LLC, except where something is credited otherwise. "XYZ Makes", the wordmark and the cube mark are the studio's. You may quote and link to anything here with attribution; you may not reproduce the marks in a way that suggests the studio endorses or is connected with what you are doing.
Software
Applications are licensed, not sold. Unless a particular application ships different terms with it, you get a personal, non-exclusive, non-transferable licence to use it on devices you control, and you agree not to reverse engineer it, redistribute it, or use it to break the law. Software bought through the App Store is also subject to Apple's own terms, and where those give you more, they apply.
Liability
To the fullest extent the law allows, the studio is not liable for indirect or consequential loss, lost profits, or lost data arising from this site or from software provided free of charge. Where liability cannot be excluded, it is limited to what you paid for the thing that caused it. Nothing here excludes liability for fraud, or for anything else the law does not permit to be excluded — and if you are a consumer, your statutory rights are unaffected.
Governing law
These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law rules, and the courts of that state have exclusive jurisdiction over any dispute arising from them.
Changes
These terms may change; the date at the top says when they last did. Continuing to use the site after a change means you accept the current version.
